Serena Yang

Serena obtained her LL.B. at Fudan University, one of China’s top law schools, and her LL.M. at the University of Chicago Law School, where she graduated at the top of her class.

Serena specializes in securities and commercial litigation, including foreign judgment enforcement cases. Trained both as a transactional lawyer and a litigator, Serena is equipped with the mindset of both, with exceptional attention to details and a keen awareness of potential risks. Her prior transactional experience provides her with a deep understanding of complex securities and financing transactions, offering unique insights into securities and commercial litigation.

Prior to joining MoNi, Serena was an associate at King & Wood Mallesons, one of China’s leading law firms. She represented major banks, financial institutions, and real estate companies in structured finance and securitization, cross-border lending, mergers and acquisitions, regulatory compliance, and general corporate matters.

• Successfully secured dismissal of Section 11 strict liability claims against a OTC-listed Chinese education company before the Southern District of New York

• Successfully secured dismissal of 10b-5 securities fraud claims against a NYSE-listed Chinese tech company before the Southern District of New York

• Defending underwriters in a Section 11 strict liability claims against a NASDAQ listed Chinese advertising company before the Southern District of New York

• Advising a NASDAQ-listed Chinese tech firm in an action involving SPAC disputes and claims for Securities Act violations before the Supreme Court of New York

Foreign Judgment Enforcement

• Successfully obtained an order from the King County Supreme Court recognizing a Chinese court judgment – first time a Washington court recognized and enforced a Chinese court judgment under the Uniform Foreign-Country Money Judgments Recognition Act

• Representing client in an action seeking recognition and enforcement of a Chinese court judgment in California state court, achieving a swift and favorable settlement (under the supervision of California licensed attorney)

• Advising client in an action seeking recognize and enforcement of a Chinese court judgment in California state court (under the supervision of California licensed attorney)

• Successfully defended a NASDAQ-listed Chinese tech company in a derivative action before the Wyoming Chancery Court (pro hac vice)

• Represented a client in crypto-related contract disputes in New York state court, achieving a successful settlement

• Defending a NASDAQ-listed Chinese tech company in a corporate books and records demand lawsuit before the Wyoming District Court (pro hac vice)
